Terms of Service

These terms are between you and [legal entity name], who operates Orbit. By installing or using Orbit you agree to them. If you do not, please do not use it.

1. What Orbit is

Orbit shares the location of people who have chosen to share it, with the other members of their circle. It also records a trail of past positions for as long as each person chooses, raises alerts when someone arrives at or leaves a saved place, and lets anyone send an SOS to their circle.

Orbit is provided free of charge. There is no subscription, no paid tier and no advertising.

2. Your account

• You must be at least 13 years old to create an account.
• An account is created automatically when you first open the app. You may attach an email address and password so it survives a lost or replaced phone, and so you can sign in to the web dashboard.
• You are responsible for keeping your password secure and for what happens under your account.
• You may delete your account at any time. See Deleting your account.

3. Tracking other people

You agree that you will not:

• install Orbit on someone else's device without telling them, or set it up on a device you give to an adult without their knowledge
• use it to monitor a partner, ex-partner, employee or any other adult who has not agreed
• use it to harass, stalk, intimidate or control anyone
• attempt to defeat the controls that let someone pause sharing or hide from an individual

Where a child in your care is concerned, you are responsible for deciding whether sharing is appropriate, and for complying with the law that applies to you. We recommend telling them.

4. Acceptable use

You also agree not to:

• use Orbit for any unlawful purpose
• interfere with the service, attempt to gain unauthorised access, or probe the security of the systems behind it
• attempt to extract data belonging to circles you are not a member of
• use automated means to create accounts or generate traffic
• send false SOS alerts

We may suspend or remove accounts that breach these terms.

5. Accuracy and availability

Orbit reports location as accurately as the device and its surroundings allow, and it tells you how accurate each position is rather than presenting every fix as certain. Even so:

• satellite and network positioning is imprecise, and indoors it can be very imprecise
• a phone that is switched off, out of signal, in battery-saver mode or restricted by its operating system will stop reporting, sometimes without warning
• notifications depend on networks and on the recipient's device settings, and may be delayed or not arrive
• the absence of an alert does not mean nothing happened

Orbit is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that any position, alert or history is accurate or complete. Do not use Orbit as the only means of knowing whether someone is safe.

6. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else which cannot lawfully be limited.

Subject to that, and because Orbit is provided free of charge, we are not liable for any indirect or consequential loss, loss of profit, loss of data, or loss arising from reliance on a position, alert, absence of an alert, or item of location history. Our total liability to you in connection with Orbit is limited to £100.

If you are a consumer, you have legal rights that these terms do not affect.

7. Changes to the service

We may change, suspend or discontinue Orbit, in whole or in part, at any time. If we discontinue it we will give reasonable notice in the app where we can, so you have time to export or delete anything you want to keep.

8. Ending it

You may stop using Orbit and delete your account at any time. We may suspend or end your access if you breach these terms, or if we stop providing the service.

9. Privacy

How we handle personal data is set out in the Privacy Policy, which forms part of these terms.

10. Changes to these terms

We may update these terms. The date at the top will change, and for material changes we will tell you in the app before they take effect. Continuing to use Orbit after that means you accept the new terms.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may bring proceedings in your local courts.
